There are almost no legal formalities to forming a sole proprietorship. If the proprietor has employees, the main step is obtaining a federal employer identification number (EIN) from the IRS by filing a Federal Form SS-4. If the proprietorship has no employees, the owner can simply use his or her Social Security number as the business identification number. However, the IRS still prefers that the proprietorship obtain an EIN.
